Could be - but how are you determining that?

We're looking into an area that's not lit at all... no studio lights angled that way.
Total shade.
They might be black, or red, or blue, or even white.
Hell, Kate could be commando there for all we know.

It's a nice perspective she's giving us there, but there's no way to tell.

I agree, it's getting out of hand. Nowadays, every leg cross is marked as an upskirt. Just because you are technically looking up her skirt doesn't make it a true upskirt. Like pacific said, we don't what we're looking at. It could be that dreaded spanx.

First let me say that this Kate post is extremely pleasant to say the least. And thanks much eggman! But when it comes to the panty debate here I have to say that I'm not seeing anything but darkness.
